Terms of Service

“Photoenroll,” “we,” “us,” and “our” refer to Unleavened LLC, a Delaware limited liability company with its principal place of business in New York, doing business as Photoenroll.com (the “Service”). The Service uses facial recognition technology to help parents and guardians find photos of their children in galleries uploaded by camps, schools, photographers, and event hosts (each, a “Partner”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

If you create an account or enroll a child, you also agree to our Notice to Parents (COPPA + biometric data) and to provide the consents required there.

You must be at least 18 years old and the verified parent or legal guardian of any child you enroll. Children do not create accounts; all enrollment occurs through a parent or guardian account.

If you are using the Service in a Partner capacity (e.g., camp administrator, photographer, or event host), you represent that you have authority to act on behalf of the organization you represent and that the organization has the rights necessary to upload the photos in question.

• You are responsible for the activity on your account. Keep your password and any authentication credentials secure.
• You agree to provide accurate, current information at signup and to keep your contact details current.
• Notify us promptly at security@photoenroll.com of any unauthorized access or suspected breach.

You agree that you will not:

• Enroll any person other than yourself or a person you have legal authority to enroll. You may not enroll another person without their consent (or, for a minor, the consent of their parent or guardian).
• Use the Service to identify, surveil, harass, stalk, or harm any person.
• Upload photos you do not own or do not have the rights to distribute, or photos that depict people who have not consented to inclusion in the relevant Partner's gallery.
• Probe, scan, or test the vulnerability of the Service, or attempt to bypass authentication, rate limits, or access controls.
• Use the Service to develop a competing facial recognition product, or scrape, crawl, or mass-export data from the Service.

The Service offers a free tier and an optional paid tier (“Pro”). Pricing may change with advanced notice for future billing periods. Payments are processed by Stripe, Inc.; we do not store your full card number.

• Auto-renewal. Pro subscriptions auto-renew at the then-current price until cancelled. You may cancel at any time from the billing portal accessible in your account.
• Refunds. Except where required by law, fees are non-refundable. Mid-period cancellations stop future renewals; access to Pro features continues through the end of the paid period.
• Free tier. We may change what the free tier includes with reasonable advance notice. Any feature that is already paid for continues to be available for the period you paid for.
• Taxes. Stated prices do not include applicable taxes; you are responsible for any tax owed on your purchase.

Photoenroll is a biometric service. To match a child to photos in a gallery, we create and use a mathematical face template (an embedding) derived from reference photos you provide. We treat biometric data of all users with the protections required by the Illinois Biometric Information Privacy Act (BIPA), regardless of where you live: written consent at enrollment, retention limits, and a published retention and destruction schedule. Our Privacy Policy and COPPA Notice describe how this works.

By enrolling yourself or a child, you authorize us to create, store, and use a face template for the purpose of matching against Partner photo galleries you select, and you agree to be bound by the consent terms presented at enrollment. You may withdraw consent at any time from your account settings.

• Your content. Reference photos and consent recordings you submit (“Your Content”) remain owned by you. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use Your Content solely to operate the Service for you — including running the matcher, sending notifications, and retaining the consent record. This license ends when Your Content is deleted, except for the consent record itself, which we retain as required by law.
• Partner content. Partners retain ownership of photos they upload. They grant us a license to host and process those photos to run face matching for their enrolled families.
• Our content. Photoenroll software, brand, interface, and design are owned by Unleavened LLC and protected by intellectual property laws.

You may close your account at any time from the account settings page. On closure we delete your biometric data (face templates, reference photos, and gesture/consent video frames not required as consent evidence) and your account record. The standalone consent recording and the consent-log entry documenting that consent was given are retained as required by law.

We may suspend or terminate accounts for violations of these Terms, for security or legal reasons, or after extended inactivity. We will use commercially reasonable efforts to give you notice before doing so, except where prohibited.

Facial recognition is a probabilistic technology. We do not guarantee that every photo containing your child will be matched, that no incorrect matches will occur, or that the Service will be uninterrupted or error-free. The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, in no event will Unleavened LLC, its officers, directors, employees, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to the Service.

Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim and (b) one hundred U.S. dollars ($100). Nothing in these Terms limits any liability that cannot be limited under applicable law, including (where applicable) liability arising under BIPA or comparable biometric privacy statutes.

You agree to indemnify and hold harmless Unleavened LLC and its personnel from any claim, demand, or liability (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or any rights of another person, including any claim that you did not have the rights to enroll a person or to upload a photo.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Nassau County, New York, and you and we consent to personal jurisdiction there.

We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date and, for material changes, notify registered users by email. Continued use of the Service after the effective date of the change constitutes your acceptance of the updated Terms. Where the law requires renewed affirmative consent (for example, for changes to biometric processing), we will request it before applying the change to your data.
